Requires milk beverages to be labeled in a manner that does not comply with the National Conference of Interstate Milk Shippers Pasteurized Milk Regulations and may violate the Interstate Commerce Clause of the U.S. Constitution.</p>

RELATING TO PROCUREMENT.</strong><br />
Needlessly requires the State Procurement Office to authorize reseller agreements in multi-state contracting agreements, and narrowly defines &#8220;local reseller&#8221;.</p>

RELATING TO BUILDING DESIGN FOR PERSONS WITH DISABILITIES.</strong><br />
Increases the cost of planning and designing housing, public buildings, and other construction by allowing the Disability and Communication Access Board (DCAB) to charge a significant fee for the review of American Disabilities Act compliance.</p>
<p><strong><a title="HB2239" href="http://www.capitol.hawaii.gov/session2010/lists/measure_indiv.aspx?billtype=HB&amp;billnumber=2239" target="_blank">HB2239 SD2 CD1</a><br />
RELATING TO THE DEPOSIT BEVERAGE CONTAINER PROGRAM.</strong><br />
Increases the cost of dietary supplements and impacts consumers purchasing healthy beverages by repealing the exemption such supplements currently have from the Hawai‘i Deposit Beverage Container Recycling Program.</p>

RELATING TO EDUCATION.</strong><br />
Amends the Board of Education composition and member selection process in a manner that may not ensure the Board will be composed of members who reflect the best interests of the public and who understand the role of setting public education policies.</p>

RELATING TO PROCUREMENT.<br />
</strong>Creates unrealistic deadlines for the Department of Transportation and Department of Hawaiian Home Lands to award public contracts on bid proposals, and encourages inappropriate relationships by specifying that gifts made to the State shall not constitute or require a procurement contract.</p>

</strong>Authorizes the issuance of up to $40,000,000 in Special Purpose Revenue Bonds to Carbon Bio-Engineers despite possible patent ownership and licensing issues associated with this firm.</p>

RELATING TO REAL PROPERTY.<br />
</strong>Extends Act 189, Session Laws of Hawai‘i 2009, which changes the process for renegotiating the amount of rent during the term of an existing commercial or industrial lease, despite litigation that has deemed the Act unconstitutional.</p>

</strong>Allows salary increases and bonuses for the Department of Education&#8217;s Superintendent, Deputy Superintendent, Assistant Superintendents, Complex Areas Superintendents, and the State Librarian at a time when other State workers are losing their jobs, being furloughed, or experiencing salary reductions.</p>

Jeopardizes federal funding for certain Medicaid services by authorizing health plans under Medicaid or QUEST programs to deliver telehealth services without the approval of the Federal Centers for Medicaid and Medicare Services or oversight by the Department of Human Services.</p>

RELATING TO BAIL.<br />
</strong>Adversely impacts state and county law enforcement agencies by requiring them to divert limited resources to accept bail on weekends and holidays when the courts are closed, without the proper training, facilities or staffing.</p>

RELATING TO SMALL BOAT HARBORS.</strong><br />
Favors a specific landowner and certain tour operators by requiring the Department of Land and Natural Resources to regulate commercial boat operators bringing visitors onto “quasi-public” property despite the Department lacking necessary resources to do so.</p>
<p><strong><a title="SB2566" href="http://www.capitol.hawaii.gov/session2010/lists/measure_indiv.aspx?billtype=SB&amp;billnumber=2566" target="_blank">SB2566 HD2 CD1</a><br />
RELATING TO MEDICAL AND REHABILITATION BENEFITS.</strong><br />
Increases workers&#8217; compensation costs and the potential for conflicts of interest by allowing doctors to perform one-time diagnostic consultations at medical facilities in which they have a financial interest, without verification from the insurer or employer that the consultation is necessary.</p>

RELATING TO CONVEYANCE TAX.<br />

<p>Governor Lingle in a press conference today vetoed a bill that would have granted the same rights and benefits of marriage to same-sex couples. &#8221;I have been open and consistent in my opposition to same-sex marriage, and find that House Bill 444 is essentially same sex marriage by another name,&#8221; she said. Lingle also stated the issue is of such societal importance it deserves to be decided by all the people of Hawaii.</p>
<p>At the end of a long road, both proponents and opponents of <a title="HB444" href="http://www.capitol.hawaii.gov/session2010/lists/measure_indiv.aspx?billtype=HB&amp;billnumber=444" target="_blank"><strong>HB444</strong></a> gathered on the steps of the State Capitol and waited for hours to hear the governor&#8217;s decision on civil unions in Hawaii. With each group claiming their separate areas, the State Capitol was physically divided today by an invisible line. It served as a sad reminder of how divisive this issue still is. </p>

			<content:encoded><![CDATA[<p>Senate President Colleen Hanabusa today sent out a <a href="http://www.hawaiisenatemajority.com/wp-content/upLoads/2010/07/Special-session.pdf">memo</a> notifying members that the House will not be convening in a special session for the purpose of overriding Governor Lingle&#8217;s vetoes. The <a title="House Blog" href="http://hawaiihouseblog.blogspot.com/2010/07/house-not-calling-for-special-session.html" target="_blank">House blog</a> posted the following reasons as to why Speaker Calvin Say, in concurrence with House Leadership, decided the bills on the governor’s veto list did not warrant an override:</p>
<blockquote><p>• The bill does not appear to have the requisite two-thirds vote in both chambers necessary to override a veto;</p>
<p>• The bill does not rise to a sufficient level of statewide concern to warrant the extraordinary action of a legislative override;</p>
<p>• The Governor&#8217;s preliminary objections to the bill have sufficient merit deserving of further evaluation;</p>
<p>• Although the bill was intended to enhance state revenue to balance the budget when passed during the session, it is now no longer necessary because of the Council on Revenue&#8217;s improved revenue projection.</p>
<p>&#8220;It&#8217;s my personal belief that simply because we have the legislative super-majority to override is not justification for us to do so. Partisan politics should not be a consideration or basis for any policy decision. The House should be proud of the work accomplished during the regular session – including balancing the state&#8217;s budget without increasing the general excise tax, without increasing income taxes on low- and moderate-income families, and without scooping the counties’ hotel tax share,&#8221; said Speaker Calvin Say.</p>
<p>On June 21, 2010 the Governor released to the Legislature her list of 39 bills that were intended for veto. The list included bills on public safety, civil union, homelessness, education and more.</p></blockquote>

<p>Senate President Colleen Hanabusa today issued the following statement expressing her condolences on the passing of former Hawaii Chief Justice William S. Richardson:</p>
<p>&#8220;I am deeply saddened to hear of the passing of Chief Justice William S. Richardson, who did so much for our state, our judiciary, and for Native Hawaiians. I offer my condolences to his family and to all of those who will feel his loss.</p>
<p>&#8220;I consider myself fortunate that I was able to get to know C.J. Richardson and to have a chance to discuss so many important issues with him. I gained a great deal from his valuable insights on a host of issues facing our state, not the least of which was the rights of Native Hawaiians and the vital importance of preserving our host culture.</p>
<p>&#8220;I believe this is a time for us to stop and consider the great impact C.J. Richardson had on our state. In the areas of land and water rights, his leadership on the Hawaii Supreme Court helped protect the rights of ordinary people. His advocacy helped ensure the establishment of the law school that bears his name, allowing us to educate lawyers who truly understand local issues. I am proud to be among its graduates.  More recently, I often saw him at the law school, lecturing to or meeting with students, to share his lifetime of experience.</p>
<p>&#8220;For his generosity, his guidance, and his deep love for Hawaii, we owe William Richardson a great debt. I will miss him.&#8221;</p>

<p>The bills are being considered for potential veto due to various factors including:</p>

4. Technical flaws in the legislation.</p>
<p>The Governor has placed some bills on the list to preserve her option to veto them while the Administration continues to review them.</p>
<p>“While the Legislature each year passes legislation it believes is important, it is my duty as Governor to ensure the bills that become law are constitutional, fiscally responsible and in the State’s and the public’s long-term best interest,” said Governor Lingle.</p>
<p>“This year, as in prior years, my Administration is taking a prudent approach of questioning bills that use limited State resources ineffectively or that would hamper our economic recovery,” the Governor added.</p>
<p>The Governor is required by the Hawai‘i Constitution to give the Legislature <strong>10 days notice</strong> of any bill she is considering vetoing, prior to the deadline when she must take final action on the bills passed in the 2010 legislative session. This year the deadline to veto bills is <strong>July 6</strong>.</p>

<p>“While it may be appealing to say that we should impose zero tolerance and simply take away the licenses of those convicted of DUI, the reality is that people whose licenses have been revoked still need to get to work, to transport their families, and to fulfill other obligations, and there is still no efficient alternative to driving. We needed another tool to address it, and this ignition interlock legislation provides just such a tool.”</p>

<p>Senate Committee on Labor and House Committee on Labor &amp; Public Employment yesterday held a joint informational briefing to explore questions that have arisen over the Hawaii Department of Labor &amp; Industrial Relations (DLIR) and Hawaii Occupational Safety &amp; Health Division&#8217;s (HIOSH) investigation into the death of a worker in the collapse of a Hawaiian Cement tower at Campbell Industrial Park in May, 2009.</p>
<p>HIOSH issued $750 fines each to AG Transport, a contractor hired to demolish the tower, and the general contractor Sans Construction of Hawaii, for violating safety rules.</p>
<p>In a letter to DLIR director Darwin Ching dated May 11, Senate Labor chair Dwight Takamine and House Labor &amp; Public Employment chair Karl Rhoads said, &#8220;Such fines appear rather small, considering that statutorily you have the authority to fine up to $7,000. Moreover, we are concerned that these small fines will fail to act as a deterrent to others that endanger worker safety.&#8221;</p>
<p>&#8220;We want some clarity on how the DLIR and its director determined the fine,&#8221; said Sen. Takamine. &#8220;The companies failed to provide a required, written engineering survey of the tower that they were supposed to have before starting work. The result was a fatal accident. How does this warrant a $750 fine?&#8221;</p>
<p><span id="more-2783"></span>&#8220;One purpose of the statutory fine is to encourage contractors to follow the safety rules,&#8221; said Rep. Rhoads. &#8220;A small fine is not a deterrent, particularly when you consider that their failure to follow the established safety standards apparently led to exactly the kind of accident the standards are intended to protect against.&#8221;</p>
<p>&#8220;DLIR, HIOSH and Director Darwin Ching may have their reasons for imposing a fine far below the maximum allowed by law,&#8221; Senator Takamine concluded, &#8220;but their reasoning is not clear to us. We think they should explain their decision, for the sake of Hawaii&#8217;s workers, for the man who lost his life, and for his family.&#8221;</p>
<p>Killed in the May 2009 collapse was Juan Navarro of California, who was preparing the 168-foot tower for demolition at the time of the collapse. He was an employee of AG Transport.</p>

<p>&#8220;The Republic of Kiribati is a particularly meaningful place for us to gather and discuss climate change,&#8221; English said. &#8220;It is made up of hundreds of low-lying atolls which are at the forefront of high sea rise and the potentially devastating effects of climate change. Most of the island countries, states and territories of the Pacific are the least to contribute to climate change, but are the most vulnerable to its effects.&#8221;</p>
<p>&#8220;Kiribati is our &#8216;canary in the coal mine&#8217; when it comes to changes in sea levels,&#8221; English continued. &#8220;We may see the effects there first, but we will also eventually see them in Hawaii as well.&#8221;</p>
<p><span id="more-2774"></span>&#8220;If the ocean around Hawaii were to rise three feet, Waikiki would be under water,&#8221; English said. &#8220;All of us across the Pacific, large and small, need to address these questions now, before it is too late.&#8221;</p>
<p>This is also English&#8217;s final General Assembly as president of APIL. He was elected to the post in May, 2008, after serving two terms as vice president.</p>
<p>&#8220;It has been an honor to help lead this very dedicated group,&#8221; he said. &#8220;We have had an opportunity to examine a number of areas of mutual interest where regional cooperation, coordination, exchange and assistance can help our individual governments achieve important goals through collective action. I’m glad that Hawai‘i has played a role in these efforts, and that I have had an opportunity to contribute whatever I could to the discussion.&#8221;</p>
<p>The APIL’s mission is to organize a permanent association of mutual assistance by representatives of the people of the Pacific Islands. Current issues before the APIL include those arising in the areas of Resources and Economic Development, Commerce, Legislation, Energy, Regional Security and Defense, Communications, Cultural Appreciation, Health and Social Services, Education, Agriculture, Air and Sea Transportation, Aquaculture, Sports and Recreation, Youth and Senior Citizens, Tourism, Finance, Political Status, External Relations, and Development Banking.</p>
<p>Among the Pacific Island states participating in the APIL are American Samoa; Commonwealth of the Northern Mariana Islands; Federated States of Micronesia States of Chuuk, Kosrae, Pohnpei, and Yap; Island of Guam; Republic of the Marshall Islands; Republic of Palau; State of Hawai‘i; Republic of Kiribati; and Republic of Nauru.</p>

<p style="text-align: left;">This has been an awesome year for the James Campbell High School (JCHS) Sabers.  Tyson Tynanes-Perez successfully defended his state wrestling title.  Chabrielle Gushi took the OIA Girls wrestling title.  The boys wrestling team placed first in the OIA.  Rudy Cabalar, Jr. is the new state golf champion.  The robotics team scored first place titles at the Maui Invitational, Hawaii Region FIRST, West Oahu, Leeward Coast, and Northridge tournaments, as well as three Judges&#8217; Awards for best robot, and other awards.  The media team got top honors in Brown Bags to Stardom and E Ola Pono competitions, and other honors in many of its other contests.  The Naval Junior Reserve Officers&#8217; Training Corps has received the distinguished unit title for eleven consecutive years.  Three students won Pacific Asian Affairs Council travel scholarships to Vietnam.</p>
<p><span id="more-2897"></span>I am proud to represent a school where students invest in their own education and are motivated to excel, not just show up and get by.  JCHS is up for a National School Change Award, a recognition it well deserves.  Located in one of the poorest areas in Hawaii, in older days, students thought little beyond getting married and getting a job, and went to school because it was required and dropped out as soon as they wore out their parents. No more. Now JCHS is a school brimming with achievements. </p>
<p>Educational reform has long been a campaign issue.  Governor Lingle ran on a never-materialized promise that she would replace the DOE bureaucracy, with its 80% administration/20% teacher ratio, and put in local school districts instead.  The year-long Friday Furloughs that affected 170,000 public school students put changing the current system at the forefront.  One idea is to make principals the &#8220;CEOs of their schools&#8221; both to increase motivation and accountability for improving school performance. </p>
<p>James Campbell&#8217;s turn-around is a stellar example of the tremendous influence of a principal and the vitality of the teachers who work with her.  Principal, Dr. Gail Awakuni, is JCHS&#8217; driving force.  Her <em><span style="text-decoration: underline;">one band, one sound</span></em> philosophy is that the collaborative, dedicated effort of her teachers, counselors, and staff all function together so that students benefit from their time at JCHS. </p>
<p>James Campbell High School leads the State of Hawaii in redesign, finding innovative ways to open horizons and help the entire range of its students to find their avocation, be it the military, college, or work force.  In its quest for teaching methods that actively involve students in their own learning, JCHS became the first and only public school to implement AVID, NOVA.NET online learning, inclusion, Permethean Boards, Achieve 3000, Read 180, Cognitive Tutor, I-Grading of progress over time, and Response to Intervention (RTI).  All students are given opportunities for service learning, projects, internships, Senior Projects, and running start programs with the Chaminade University and University of Hawaii system.   In 2007, JCHS became the first public school in Hawaii to be given approval for the International Baccalaureate Diploma Programme (IBDP), a distinction held by only 2000 schools around the world. </p>
<p>JCHS&#8217;s open enrollment policy allows motivated students of all GPAs to challenge themselves in subjects they are interested in, via AP, AVID or IBDP.  As a result, students excel in subjects they had not previously considered.  Ten years ago there were only two AP courses; now there are 22.  JCHS has high enrollment in science, AP, and rigorous honors courses, and the AVID and IBD programs.  A majority of students take science all four years.  Last year, 1 out of 6 students (16%) took Advanced Placement (AP) exams. </p>
<p>Principal Gail Awakuni&#8217;s dynamic leadership and the beyond-the-call-of-duty team efforts of her teachers and staff to reach out to the youth of Ewa have completely changed James Campbell High School.  The proof of this change is all around.  Ten years ago, 50% of freshmen dropped out of high school in their first year.  Today, 95% finish freshman year, and of those, 97% stay in school through senior year, one of the highest rates in Hawaii.  One-third of the student body is on the Honor Roll; 99% of seniors graduate; 74% of students go to college.  Last year, students received $10.5 million in college scholarships, including the highly competitive Gates, Quest Bridge, Horatio Alger, and Dell scholarships.  In 2004, JCHS was one of 30 schools across the U.S. selected as a <span style="text-decoration: underline;">Gates Foundation Pathways to College Access School</span> for sending students from underserved populations to college.</p>
<p>A multitude of Saber awards, honors, championships, and titles span a diverse range, for both students and faculty.  For its turnaround, James Campbell High School was named a 2004 National Association of Secondary School Principals &#8220;Break-Through School&#8221; for 2004.    JCHS has shared the effort behind its success in changing the school culture at national conferences such as AVID and the National Association of College Admissions. </p>
<p>For several years now, JCHS has met its Adequate Yearly Progress (AYP) several years in a row in all but one category.  Last year, JCHS was one of only three high schools and the only Title I high school in Hawaii to do so.  As the largest high school in the Hawaii with the second largest special education population, its special education scores are the state&#8217;s highest, as a result of its successful co-teaching, inclusion program. </p>
<p>JCHS&#8217;s achievements prove that the key to improving our schools is to create an environment and provide opportunities so students know they can achieve more than they expected of themselves.  &#8220;There is life past Renton Road,&#8221; the saying goes at the Saber campus, and their success shows that our schools can be places where students invest in their future.</p>
<p>The Varsity and Junior Varsity girls soccer team took the state championships for 2007, with the Varsity girls team going on to third place in the U.S. championship.  Lowen Tynanez-Perez placed first in the 2007 state wrestling championship and later took third place in the 10<sup>th</sup> Annual Cliff Keen World High School Wrestling championship.  The Varsity Girls Basketball won the 2008 state championship. </p>
<p>Marites Barangan was honored as a Miliken &#8220;Teacher of Promise&#8221; for 2008.   , Wendell Tashiro was named the &#8220;2008-2009 State of Hawaii Career and Technical Education Teacher of the Year&#8221; for his 3-D computer Auto Cad program.  Counselors Eleyne Fia (2007-2008) and Rick Yamashiro (2008-09) were both named the &#8220;State of Hawaii Counselor of the Year&#8221;. </p>
<p>In 2008, JCHS won first place in the state Pacific Asian Affairs Council (PAAC) WorldQuest Competition, no small feat in a contest of 65 other teams from private and public schools statewide.  The victory earned the team a bid in the national competition.  Each year, at least one Saber is awarded a Pacific Asian Affairs Council travel scholarship, which has taken students to Beijing, Taiwan, South Korea, and Vietnam.  In 2003, James Campbell became the first Leeward Oahu school to place first in the state Math Bowl competition, and remains the only Leeward school with this accomplishment.</p>
